While most know the exchange of money for sexual acts is unlawful, Illinois Prostitution encompasses more than the mere exchange of money under its Prostitution law. The law prohibits the exchange of "anything of value," for sexual acts. This means that, in addition to currency, other tangible items (e.g., jewelry, electronics, the payment of a phone bill) would be sufficient consideration to trigger the Prostitution law.

The law also provides immunity and/or affirmative defense to those who are arrested for committing Prostitution if they are either the victims of involuntary servitude or trafficking at the time of the alleged act of prostitution or if they are under the age of 18.

The Sentence – CLASS A MISDEMEANOR

Patronizing a Prostitute

As often is the case with sex offenses in Illinois, whether or not a specific act constitutes a crime depends heavily on the definition of words used in the law. Under Illinois law, sexual penetration is defined as any contact, however slight, between the sex organ or anus of one person and an object or the sex organ, mouth, or anus of another person, or any intrusion, however slight, of any part of the body of one person or of any animal or object into the sex organ or anus of another person.

In addition to banning any sexual penetration or contact for sexual gratification, the Patronizing a Prostitute law prohibits an individual entering any place of prostitution or remaining in any place of prostitution, even if he or she does not engage in any type of sexual conduct, so long as the entrance or presence is coupled with the intent to engage in sexual conduct.

The Sentence – CLASS 4 FELONY

- 1 to 3 years in state prison

- Fine of up to $25,000

CLASS 3 FELONY IF:

  • Committed within 1,000 feet of a school
  • Second or subsequent offense

    • Soliciting for a Prostitute
    • Keeping a Place of Juvenile Prostitution
    • Patronizing a Juvenile Prostitute
    • Pimping
    • Juvenile Pimping/Aggravated Juvenile Pimping
    • Exploitation of a Child

- 2 to 5 years in state prison

- Fine of up to $25,000

Probation Possible? Yes.

Supervision Possible? No.

Sex Offender Registration Requirement? Yes, if the victim is under the age of 18.

Solicitation of a Sexual Act

Along with laws prohibiting the solicitation of a prostitute, Illinois makes it illegal for individuals to solicit sexual acts from individuals who are not engaged in the act of prostitution. In addition to prohibiting the offering of money for a sexual act, the law prohibits the offering of any item object in exchange for a sexual act. This law applies both to the one seeking the sexual act, or the one seeking the money or other item of value.

Furthermore, the law prohibits a person who is convicted of Prostitution from also being convicted of Solicitation of a Sexual Act if the act leading to the Prostitution conviction consists only of the accused's own act of Prostitution.

Finally, the law provides an affirmative defense to the offense if the charged individual was under the age of 18, or if the charged individual suffered from severe or profound intellectual disability at the time of the offense if the accused reasonably believed the victim was over the age of 18 or was not a person with a severe or profound intellectual disability.
