Illinois Casual Delivery of Cannabis

The Law – 720 ILCS 550/6

Any delivery of cannabis which is a casual delivery shall be treated in all respects as possession of cannabis for purposes of penalties.

Casual delivery is the delivery of cannabis, including its oils, seeds and resins, of up to 10 grams, without consideration. Consideration is money, or any other goods or services, tendered in exchange for the cannabis. For instance, if one person allows his or her friend the consumption of cannabis without asking for anything in return, Casual Delivery of Cannabis was committed. The key here is the amount being less than 10.1 grams. The punishment for Casual Delivery of Cannabis is much less severe than the “ordinary” delivery of cannabis and is treated as simple Possession of Cannabis for sentencing purposes. However, if the amount is more than 10.1 grams, than the individual who delivered the cannabis without receiving any consideration is subject to the same harsh penalties as someone who received cash for the delivery of the cannabis.
